(s) violates any applicable law for the time being in force.

You hereby accept full responsibility for any consequences that may arise from your use of the Website, and expressly agree and acknowledge than in no event and under no circumstances shall Animal Health Pathology Lab be held liable to you for any liabilities or damages resulting from or arising out of your use of the Website. Your User Account can be terminated at any time by: (a) You, by withdrawing your consent and ceasing to use the Website by writing to us at protip.c@labahpl.in; or (b) Animal Health Pathology Lab, in its sole discretion for any reason or no reason, including your violation of these Terms or lack of use of the Website. You acknowledge that the termination of access to the Website may be affected without any prior notice, and Animal Health Pathology Lab may immediately deactivate or delete the User Account and all related information and/or bar any further access to the User Account or the services provided on the Website, subject to applicable law. The disclaimer of warranties, the limitation of liability, and the governing law provisions shall survive any termination of these Terms.

Representations:

You hereby represent and warrant that you have validly entered into these Terms and have the legal power to do so. You further represent and warrant that you shall be solely responsible for the due compliance with these Terms.

Limitation of liability:

Fees:

All fees/Services/treatments, diets and medicinal charges are at the current rate. Fee level is included as a part of time spent on the case and accordingly medications, materials & consumables used. Details of our fees are available on request and a detailed invoice is provided for every consultation procedure or transaction. Estimates can also be provided on request.

Estimates of Treatment cost:

We will upon request be pleased to provide an estimate as to the probable cost of treatment. Please bear in mind any estimate given can only be approximate as sometimes a pet’s treatment may not follow a conventional course.

Settlement Terms:

All invoices are to be settled at the end of the consultation, and the discharge of your pet upon collection of medications / diets. Animal Health Pathology Lab has a “NO CREDIT POLICY”. Please note that overdue accounts will be liable for extra penalty & potential legal charges be referred to our legal team. Please ensure all accounts are settled at end of consultation & discharge.

Any cheque which you issue which is returned unpaid, any credit card not honoured that is found to be counterfeit will result in your balance been resorted to original sum together with any fees incurred in the process.

Refund and Cancellation policy:

The Website permits payment via various modes, including cash, virtual payment wallets and online payments through debit/credit cards and internet banking or any other method adopted by Animal Health Pathology Lab from time to time. It is being expressly clarified that once any payment is made by you against any of the Services, the same is non-refundable and non-transferrable.

While availing any of the payment method/s available on the Website, Animal Health Pathology Lab will not be responsible for or assume any liability, whatsoever in respect of any loss or damage arising directly or indirectly to You due to:

(a) Lack of authorization for any transaction(s); or

(b) Exceeding the pre-set limit mutually agreed by You and between bank/s; or

(c) Any payment issues arising out of the transaction; or

(d) Rejection of transaction for any other reason(s) whatsoever.

All payments made shall be compulsorily in Indian Rupees. It is expressly clarified that Animal Health Pathology Lab will not facilitate transaction with respect to any other form of currency with respect to the purchases made on the Website.

You acknowledge that Animal Health Pathology Lab will not be liable for any damages, interests or claims, losses resulting from or suffered on account of not processing a transaction/ transaction amount or any delay in processing a transaction/ transaction amount which is beyond the control of Animal Health Pathology Lab.

Complaints and Redressal process:

Whilst we hope that our service does not give you cause for complaints, if there is something that you wish to bring to our attention, please contact our practice manager at the respective clinic immediately.

If your complaint can be resolved immediately, we will do so otherwise your complaint will be acknowledged and the incident will be investigated, and you will be contacted within 10- 15 working days. Please adhere to this redressal process. Our teams will do their very best to support you.

Security and training:

For security, staff training and prevention and detection of crime, a CCTV camera is working and is in operations. The rights of recording of the CCTV footage are the property of Animal Health Pathology Lab and will not be shared with anyone. Only government officials (police, fire department, judicial department, etc.) upon written request may be considered as per applicable law.

Ownership of records:

Animal Health Pathology Lab follows best practice standards in maintaining your pets’ records. Animal Health Pathology Lab will seek to maintain records of past treatments conducted at other clinics and will ask you to submit past medical records of your pet. If you wish to access your pets’ medical history, we request that you send a written email for the same or talk to the receptionist.

Variation in terms and conditions of business:

No addition or variation of these terms and condition will bind Animal Health Pathology Labunless specifically given in writing by its directors. Additionally, no agent or employee appointed by has the authority to alter or vary these terms and conditions in any way.

Feedback:

We are always striving to improve the service we provide and any comments positive or negative will be greatly received. If you are unhappy with any aspect of your visit- please let us know, we always value your feedback.

Assignment:

You shall not license, sell, transfer or assign your rights, obligations, or covenants under these Terms in any manner without Animal Health Pathology Lab’s prior written consent. Animal Health Pathology Lab reserves the right, at its own discretion, to freely assign and transfer the rights and obligations under these Terms to any third party.

Severability and waiver:
